We are dedicated to transparency in our privacy practices. We firmly believe in upholding your privacy and ensuring that our practices are straightforward and fair. This includes the way we treat your personal data and potentially sensitive information. Because we know that privacy matters as much to you as it does to us, we’re pleased to offer a number of settings for our users. These settings allow you to decide how some of your information is used by supermelon.

 

In this policy, we’ll detail the privacy practices of supermelon.com (referred to as the “Site”), supermelon mobile applications (referred to as the “Apps”), Pattern by supermelon, supermelon Payments, and supermelon public Application Program Interface (which we’ll call the “API”). We’ll also cover the privacy practices of all other services offered by supermelon, Inc. depending on your location (“supermelon,” “us,” “our,” and “we”).

 

Throughout the policy, we’ll be referring to the Site, the Apps, Patterns by supermelon, supermelon Payments, the API, and our other services collectively as the “Services.”

Please note that the policy outlined here does not apply to the practices of third parties, such as API users or other members who sell using the Services. These members may also receive or collect data related to your use of the Services.

1. Requirements for Using Our Site and Agreeing to the Privacy Policy

In order to keep supermelon ’s marketplace functional, there are certain pieces of your information that we need to collect and process. This is necessary to provide you and all other users of supermelon with our Services.

To participate in our Services, you must agree to our Terms of Use. As part of this agreement, you confirm that you have read and that you understand our Privacy Policy. This policy details why we use your personal information, and how we do so. If you do not agree to the use of your information as described in this policy, you may not use supermelon.

Please note that supermelon cannot and does not claim responsibility for the content or the privacy practices of individual supermelon _ members, or of third parties, including other websites and mobile apps.

To use our Services, you must be at least 18 years of age. The only way minors between the ages of 13 and 17 may use the Services is if they do so through the account of a parent or legal guardian. Minors must have the appropriate permission and direct supervision of their parent or legal guardian at all times while using supermelon _. Note that if a minor uses your account, you are responsible for all activity that the minor conducts. Children younger than 13 may not use supermelon, including any of our sites or apps.

As a supermelon member, your information will be used in the United States as well as in any other nation in which supermelon conducts operations. Your use of the Services constitutes an acknowledgment of an agreement to this use. It is important to note that privacy standards and personal data laws may vary from one country to the next. This includes the rights of authorities to obtain your personal data. supermelon will transfer the personal information of our users only to the countries where we are legally permitted to make such a transfer. Furthermore, supermelon will make a conscientious effort to ensure that our users’ data receives the appropriate protections.

2. How Supermelon Collects, Receives, and Uses Your Personal Information

supermelon may ask for or obtain your personal information through a variety of means. In most cases, you will have the opportunity to determine what personal information you provide to us. However, some specific pieces of information are required in order for us to offer you our Services.

Registration, Account Setup, Service Usage: At minimum, use of our Services requires a valid email address. For those of our Services that require registration, a name will also be required. The name that you provide will be associated with your account and will be how you are represented and identified in the supermelon _ community. After you’ve provided a name, the name can be modified or removed via your supermelon account preferences. For certain aspects of our Services, further personal information will be required. This may include a billing contact name, billing address, shipping address, shop name, telephone number, and credit card information. You will not need to provide this additional information as part of the sign-up process, but you will need to provide it if you participate in a specific Service that requires it (e.g., you won’t be able to purchase a physical item without providing a shipping address).

We also require additional information from supermelon sellers who use the supermelon _ payment service. These sellers may be expected to provide a full legal name, date of birth, credit card information, tax ID (or identification ID, or social security number, as applicable), bank account information, and other personal information. The information provided will be used to verify identity, to comply with relevant and applicable laws, and to fulfill our requirements in offering the Services. Credit card information may be stored, either by us or by a third party, for seller payouts as well as billing. You may, depending on your local laws, have the option to consent to have us store your credit card information for use in future purchases. We may, at certain times, contact sellers confidentially to collect relevant information about the seller’s shop, about the items the seller has listed for sale, or about compliance with regulations and applicable laws. Some of our Services (and products on our Services) require an application process. Unless explicitly stated otherwise, the information submitted through one of these applications will only be used internally and will never be displayed in a public forum.

Profile: Your profile allows you to share your name, birthday, gender, geographic location, and other personal information that will be associated with your account and your activity. It is up to you whether you provide this information. At any time, you can delete or edit your public profile information via your account preferences.

Please note that the name on your account will be displayed in connection with all your public activity on supermelon. Public activity includes the date that you joined, profile information that you’ve published, items you offer for sale, the pages and policies of your shop, comments you’ve posted, reviews and star ratings for items that you’ve bought and sold, your Favorites, your followers, the people you follow, and posts shared through third-party social media networks.

Automated Information: Each time you visit our Site, open the Apps, or utilize another of our Services, some information is automatically received and recorded from your browser or mobile device. This information includes your IP address or unique device identifier, cookies stored in your browser, and data about the pages you visit. We use this information, which is stored in log files, in order to keep supermelon operational and to optimize our users’ experience of the Services. This automatically recorded information may be used in combination with other information we have collected about you (or that our partners have collected about you on our behalf), on the same device or across multiple devices, for a number of important purposes. These purposes include analyzing and optimizing our Services, providing targeted advertising and personalized experiences, and keeping the Services secure by preventing fraud and recognizing unauthorized access to member accounts.

 

When you install, access, or otherwise utilize our Services, we may collect additional information specific to your device, including operating system information, hardware model, app usage, debugging reports, app version, and related data. If you’d like to know more about the information that we obtain from your device, we encourage you to read our Cookies & Similar Technologies Policy. Please also refer to the “Using and Sharing Your Information” section of this document.

 

Location Information: The primary reasons that we collect and record information about your interaction with our Services are to offer personalized content and targeted advertising, to better understand and analyze supermelon ’s operations, and to protect supermelon from fraud and disruption. The data that we collect may include the following: device information (like iOS IDFA and Android AAID, among other pieces of data), browser information (such as referring domains that led you to our Site), IP address, and, potentially, location information. Our Apps offer the option of sharing your geolocation details with us. Doing so enables you to take advantage of location-specific functionalities such as our local marketplace and integration with digital maps. You are not required to share your geolocation details in order to use the Apps. Additionally, as a  seller, you have the option of publishing your location.

Information about your location may be obtained from your profile (if you’ve publicly shared a location) or from your IP address. More precise location data may be obtained from the GPS on your mobile device, or from cell towers or wireless networks in range of your mobile device. We will secure your consent before collecting precise location data. Once we have this location information, we may record and utilize it to offer a more customized experience of our Services. Examples of this customization include the implementation of regional requirements and policies, the display of local content in search results, and the availability of accurate shipping estimates and mapping services. We may also use location information for internal performance monitoring and Site analytics, and for marketing purposes. Only non-precise location data will be used for marketing purposes.

If you choose to enable the sharing of precise geolocation details, we may share these details with third parties in order to provide you with the Services, such as payment processing, mapping services, and (to a limited extent) marketing. At any time, you have the option to withdraw your consent to sharing your precise location data with us. You may change your preferences regarding precise location data via the settings on the Apps, or the settings on your mobile device. However, we require that you share some non-precise location data with us in order to keep the Site running smoothly. Uses for the required non-precise location data include security authentication and applying localized policies. Non-precise location data may come from your IP address or from the address you have on file with us. You also have the option of allowing the Apps to access the camera on your mobile device, which will enable you to upload photographs to supermelon.

Analytics Information:  Data analytics are a critical part of our ability to ensure that supermelon is functioning properly and to continue making improvements to our Services. In order to understand how our users, engage with the Apps, we utilize mobile analytics software that captures information about app usage. Information collected by this software may include the frequency with which you use the Apps, performance and speed data, debugging information, the platform from which you downloaded the Apps, and activity within the Apps. The information collected by our analytics software is not tied to personally identifiable information submitted within the Apps.

Information from Third Parties: We may receive information submitted through an external third-party application when a supermelon member or visitor chooses to connect with our Site or register a new supermelon account through that third party. Examples of such external applications include Twitter, Facebook, and other social networks, and apps developed using the supermelon API. Information that we obtain through the third party may be used in the course of providing you with the Services. It is entirely optional to connect your supermelon account to any external third parties (although we may obtain publicly available information on social networks in order to connect with you). You have the option of sharing certain aspects of your activity through connected social media accounts. At any time, you may revoke your consent to share your activity on any social media network via your supermelon account preferences.

Non-Member Information: For the purposes of this section, we’ll refer to anyone who doesn’t yet have a registered account with supermelon as a “non-member.” We may collect or receive an email address, IP address, or other information about a person while they are still a non-member. This can happen in a number of situations, such as a non-member being invited by a member to a page on the Site, a non-member subscribing to a newsletter from supermelon , a non-member using the Guest Checkout option on a supermelon  purchase or otherwise engaging in a supermelon  transaction, or a member sending a code for a gift card to a non-member. When we do collect or receive information about a non-member, we use that information only for the express purpose that we disclosed when the information was submitted to us, or to carry out an action that has been requested and authorized by the non-member themselves.

Pattern by Supermelon: As previously explained, supermelon collects personal information from members such as unique device identifier, IP address, and information about the cookies stored in members’ browsers. This information may also be collected from non-members. If you’d like to find more information about websites hosted via Patterns by supermelon, we encourage you to read our Pattern Policy. We also provide more detail about supermelon ’s use of cookies and related technologies in the “Using and Sharing Your Information” section in this document, and in our Cookies & Similar Technologies Policy.

3. User Preferences and Options

As part of our commitment to transparency in our privacy practices, we think it’s extremely important that you have control over your own personal information. (It’s yours, after all!) That’s why we make it easy for you to add, delete, or modify information about yourself on your supermelon profile. At any time, you can alter the information associated with your supermelon _ account via your account preferences. We also provide you with a number of options in your account preferences so that you can decide how we get in touch with you.

Optional information, such as your name, can be removed so that it is no longer publicly available. If you’d like, you can make a request for the personal data associated with your account to be deleted entirely.

Depending on your location, you may also have certain additional rights with respect to your information, such as: (i) data access and portability (including the right to obtain a copy of your personal data you provided to supermelon , via your settings); (ii) data correction (including the ability to update your personal data, in many cases via settings); (iii) data deletion (including the right to have supermelon delete your personal information, except information we are required to retain, by contacting us); and (iv) withdrawal of consent or objection to processing (including, in limited circumstances, the right to ask supermelon to stop processing your personal data, with some exceptions, by contacting us).

It’s important to note that supermelon _ uses cookies and a variety of related technologies that are non-technically necessary. We provide in-depth information about these technologies--and the choices you have for opting out of them--in our Cookies & Similar Technologies Policy.

Via your account preferences, you also have the option of changing whether you receive some types of communication from us. Although some types of communication (such as service-related messages regarding transactions or legal notices) are required, other types, like newsletters, are not required. You may opt out of any optional communication from supermelon within your account preferences. To find out more about how we communicate with you, please see the “Communication with supermelon” section of this document.

It’s important to note that supermelon partners with certain third parties who help us manage our marketing and advertising on external sites, and these third parties may use cookies or closely related technologies of their own. Such technologies may be utilized to show you ads based on your online activity and browsing behavior. Within your account preferences, you can alter the settings and change the permissions granted to third-party applications that may be connected to your ____ account, such apps developed using the supermelon API or social networks like Facebook.

If you’ve decided that you do not wish to receive any sort of communication from us, or if you no longer wish to be part of the supermelon community, you are free at any time to terminate your account. We provide more information about this process here. Please note that even if you close your account, we will continue to deliver legal notices to you as required by law.

 

Please be aware that, while many changes to your account preferences will take effect immediately, others may take several days to update in our systems. This is especially true of changes to your preferences regarding email or marketing communications. We may require you to verify your identity before we process changes to your billing information, requests to close your ____ account, or other account changes that we deem to be significant.

4. Connecting through Third-Party Services

As a supermelon user, you have the option of connecting your account directly to your mobile device’s address book, a social media account, or your email service provider for the purpose of importing your contacts. If you choose to do this, will not store the login information that you provided for the connected accounts. By connecting to your mobile phone’s contact list or by searching directly on supermelon _, you have the opportunity to search for individuals by phone number or email address. We provide this functionality to make it easy for you to find and connect with people you know on our Site. Once you find someone you know on, you can choose to follow that person’s public activity. If you do so, that person will get an email (if they have elected to receive such notifications) informing them that you’ve followed them.

You have the option of changing your findability via your account preferences. If you turn off your findability, supermelon users will not be able to find you on our platform by searching your phone number, email address, or social network connections. You also have the option of removing your name and using an alias or nickname on your supermelon profile, so that you cannot be found if someone searches your name on our platform.

5. Communication with supermelon

In order to provide you with messages regarding supermelon transactions, marketing promotions, service updates, and other important information, we will sometimes need to get in touch with you. We’ll typically communicate these messages via push notification or email. By changing the settings on your desktop or mobile device, you can disable push notifications from supermelon. If you wish, you may choose not to receive marketing communications from us by clicking on the “Unsubscribe” link that is included in all marketing emails. You may also opt out by changing the email communication settings in your account preferences. Because it’s important that we’re able to reach you, we require all supermelon accounts to have a valid email address on file. We also collect some device information (such as operating system information) in order to make sure that you’re receiving notifications from us. We may request that you provide a telephone number if you ask us to call you for the purposes of transaction-related or another member support. We may also contact you via SMS, or an equivalent of SMS, for marketing or customer support purposes. We will only contact you in this manner with your consent. If you’d like to change your communications settings, you can do so through your account preferences.

Please be aware that some service-related messages are necessary, and we require that you agree to receiving these messages. This applies both to members and to non-members who use Guest Checkout. By using our Services, you are granting consent for supermelon to send emails and messages of a non-marketing purpose. Such messages or emails may be in regard to your account, supermelon transactions, or account security. For example, we will send a confirmation of your email address when you register a new account. We will also send notifications about orders from your shop, changes to service availability, new messages from buyers or our customer support team, and modification to site functionality and features.

By registering for a supermelon account, providing an email address or phone number for a Guest Checkout transaction, or subscribing to one of our newsletters, you are receiving the appropriate notice of, and agreeing to, our practice of sending marketing messages and emails. (In relevant jurisdictions and circumstances, you will be required to provide additional unambiguous consent to such messages.) You are welcome to unsubscribe from marketing communications via the “Unsubscribe” link that appears in all of our marketing messages and emails. If you’re a supermelon member, you can also opt out of marketing emails and messages via your account preferences. We remind you that it may take several days for changes to your communications settings to go into effect.

We offer the option to connect with people you know through our contact importer feature. More information about this feature is available in the “Connecting through Third-Party Services” section of this document. For contacts who are not already supermelon members, you have the ability to send invitations for them to join supermelon . Such invitations will be sent as emails on your behalf. The email invitations will contain instructions to provide recipients with the option to opt out of receiving invitations in the future. Please note that you may only send invitations to individuals who have consented to receiving one.

6. supermelon as a Social Platform

In order to promote a sense of community among our members, we provide a number of features for buyers and sellers to engage with one another in public ways. These features include our Forums and Teams. It is entirely up to you whether you choose to participate in these community spaces. If you do participate, we urge you to exercise caution and practice good judgment at all times. Information that you submit in these public spaces can be viewed and recorded by anyone, and it may be used to contact you with unsolicited messages. Any personal information that you post on supermelon is entirely your own responsibility. As a general rule, we do not delete content from public forums. Please be aware that, although your name may be removed, your posts in supermelon community spaces may remain visible and publicly available even after your account has been terminated. Additionally, please note that we may partner with third parties in order to provide our community features, and in doing so, we may need to disclose some of your information to those third-party partners.

You may choose to follow the public activity of other supermelon members, and other members may choose to follow your public activity as well. Members who follow you will receive updates on your activity, such as when you add an item or a shop to your public Favorites. You can, for any reason, choose to block any member from seeing your activity updates, and you may choose to make certain types of activity private to all members via your account preferences.

7. Using and Sharing Your Information

This policy describes the ways in which we obtain, process, utilize, and share your personal information when you use our Services. In order to collect and use your data in the ways described, supermelon relies on specific legal bases. Such legal bases include where:

         Necessary to perform the contractual obligations in our Terms of Use and in order to provide the Services to you;

         You have consented to the processing, which you can revoke at any time;

         Necessary to comply with a legal obligation, a court order, or to exercise or defend legal claims;

         Necessary for the purposes of our or a third party’s legitimate interests, such as those of visitors, members, or partners;

         You have expressly made the information public;

         Necessary in the public interest; and

         Occasionally necessary to protect your vital interests or those of others.

Note that we principally rely on consent (i) to send marketing messages, (ii) for third-party data sharing related to advertising, and, to the extent applicable, (iii) for the use of location data for advertising purposes.

supermelon may work with advertising partners, including third parties such as Google, Facebook, and others, as explained in our Cookies & Similar Technologies Policy. We do this in order to advertise both our own platform and our sellers’ products through numerous mediums and external sites. We, and our sellers, rely on your consent to do this. Our advertising practices include targeted online and offline marketing, using tools such as Google Customer Match and Facebook Custom Audience.

Where we process your information on the basis of legitimate interests, we do so as follows:

Providing and Improving our Services: We may use your information to improve and customize our Services, including sharing of your information for such purposes, and we do so as it is necessary to pursue our legitimate interests of improving our Services for our users. This is also necessary to enable us to pursue our legitimate interests in understanding how our Services are being used, and to explore and unlock ways to develop and grow our business. It is also necessary to allow us to pursue our legitimate interests in improving our Services, efficiency, interest in Services for users, and obtaining insights into usage patterns of our Services.

Keeping our Services Safe and Secure: We may also use your information for safety and security purposes, including sharing of your information for such purposes, and we do so because it is necessary to pursue our legitimate interests in ensuring the security of our Services. This includes enhancing protection of our community against spam, harassment, intellectual property infringement, crime, and security risks of all kind.

We respect your privacy.supermelon will not disclose your name, email address, or other personal information to third parties without your consent, except as specified in this policy.

It is necessary for us to utilize our members’ personal information so that we can offer and optimize our Services and our platform. We use personal information for purposes such as billing, payments, authentication, security, identity verification, aggregate reporting, and analytics. Through our case system, we may utilize information provided to us to help our members settle and resolve disputes, either with us or with other members. Based on your online activity and purchasing behavior both on and off of our platform, we may gain an understanding of the products you have an interest in, and we may use that understanding to suggest certain products that reflect your browsing activity. It is in our legitimate interest, as the provider of the Services, to customize the on-site experience of our members. This includes providing buyers with recommended items for purchase and helping sellers discover the most effective means of selling their items.

 

Because we value your right to privacy, you are in control of the privacy settings on your supermelon account. You may adjust these settings through the “Privacy” tab in your account preferences. Please be aware that it may take several days for certain changes to your privacy settings to go into effect.

 

In addition to consent as noted above, we also rely on our legitimate interest to send you marketing messages and forsupermelon advertising programs.

 

Buying and Selling: As part of the buying and selling process, supermelon will facilitate the sharing of information between the two members involved in the transaction, such as the other supermelon member's shipping address and payment status. By making a sale or a purchase on supermelon, you are directing us to share your information in this way. Since this is an important part of the Services we provide, we need to do this in order to perform our obligations under our Terms of Use. We expect you to respect the privacy of the member whose information you have received. As described supermelon Terms of Use, you have a limited license to use that information only for supermelon -related communications or for supermelon -facilitated transactions. Supermelon has not granted a license to you to use the information for unauthorized transactions or sending unsolicited commercial messages in violation of any applicable laws, including any consent requirements of the jurisdiction of the recipient. You may only add a member to your email or physical mailing list or otherwise use or store a member’s personal information in accordance with applicable laws, including any consent requirements that apply in that member's jurisdiction.

Legal and Safety: supermelon may also retain, preserve, or release your personal information to a third party in the following limited circumstances: in response to lawful requests by public authorities, including to meet legitimate national security or law enforcement requirements; to protect, establish, or exercise our legal rights or defend against legal claims, including to collect a debt; to comply with a subpoena, court order, legal process, or other legal requirement; or when we believe in good faith that such disclosure is reasonably necessary to comply with the law, prevent imminent physical harm or financial loss, or investigate, prevent, or take action regarding illegal activities, suspected fraud, threats to our property, or violations supermelon Terms of Use. In these cases, our use of your information may be necessary for the purposes of our or a third party’s legitimate interest in keeping our Services secure, preventing harm or crime, enforcing or defending legal rights, or preventing damage. Such use may also be necessary to comply with a legal obligation, a court order, or to exercise or defend legal claims. It may also be necessary in the public interest (such as to prevent crime) or to protect vital interests (in rare cases where we may need to share information to prevent loss of life or personal injury).

Supermelon receives a lawful, verified request for a member’s records or information in one of the limited circumstances described in the previous paragraph, supermelon may disclose personal information, which may include, but may not be limited to, a member’s name, address, phone number, email address, and company name. Affiliated Businesses: supermelon is affiliated with a variety of businesses and works closely with them for a variety of purposes, including assisting us to perform and improve the Services. These businesses may sell items or services to you through the Services or, with your consent, offer promotions (including email promotions) to you. Supermelon may also provide services or sell products jointly with affiliated businesses, including providing information to such partners to allow them to more effectively market to you. When an affiliated business assists in facilitating your transaction, we may need to share information related to the transaction with that affiliated business in order to facilitate your transaction, and this forms part of the Services we provide in accordance with our Terms of Use. We rely on consent (which can be withdrawn at any time) to send marketing messages and for third-party sharing relating to advertising.

Aggregated Information: As part of our efforts to maintain and grow the Services, we may share information about the demographics of our members with our business partners. This information will be in an aggregated format and will be depersonalized so that no personally identifiable information is disclosed.

Service Providers: supermelon also needs to engage third-party companies and individuals (such as payment processors, research companies, and analytics and security providers) to help us operate, provide, and market the Services. These third parties have only limited access to your information, may use your information only to perform these tasks on our behalf, and are obligated to Supermelon not to disclose or use your information for other purposes. Our engagement of service providers is often necessary for us to provide the Services to you, particularly where such companies play important roles like processing payments and shipments and helping us keep our Service operating and secure. In some other cases, these service providers aren’t strictly necessary for us to provide the Services, but help us make it better, like by helping us conduct research into how we could better serve our users. In these latter cases, we have a legitimate interest in working with service providers to make our Services better.

Business Reorganization: In some cases, supermelon may choose to buy or sell assets. Such transactions may be necessary and in our legitimate interests, particularly our interest in making decisions that enable our business to develop over the long term. In these types of transactions (such as a sale, merger, liquidation, receivership, or transfer of all or substantially all supermelon assets), member information is typically one of the business assets that is transferred. Supermelon intends to transfer information about you, supermelon will notify you by email or by putting a prominent notice on the Site and the App, and you will be afforded an opportunity to opt out before information about you becomes subject to a different privacy policy.

Third Parties: When you interact with our platform, certain aspects of your personal information may be collected by third-party plug-ins. When you see, for example, a third-party social network plug-in on a supermelon web page, such as a button to “Like” the page, you are seeing content provided by a third-party external site. The social network site (or other third party) may obtain cookies from your web browser, subject to the terms of use and privacy policy of the relevant third-party site (not the privacy policy of supermelon).

Furthermore, third parties may use some cookies and closely related technologies on our Site for the purposes of targeted online marketing, among other reasons. Access to such technologies permit our business partners to recognize your desktop or mobile device whenever you engage with our platform. It is important to note that any time you use third-party websites and external services, you do so under the terms and privacy policies of those third parties. Although we select and manage the third-party technologies that are present on our platform, those technologies are governed by the relevant third-party privacy policies. We depend on your consent to place and read cookies that are non-technically necessary.

 

We can speak only for ourselves; this policy does not apply to the practices of third parties (such as other members who sell using the Services or API users) that supermelon does not own or control or individuals that supermelon does not employ or manage. If you provide your information to such third parties in connection with your use of the Services, different practices may apply to the use or disclosure of the information that you provide to them. While supermelon requires these third parties to follow supermelon privacy and security requirements, supermelon does not control the privacy or security policies of such third parties. To the full extent applicable in your jurisdiction, supermelon is not responsible for the privacy or security practices of these sellers, API users, or other websites on the internet, even those linked to or from the Services. It is our recommendation that you thoroughly read and understand the terms of use and privacy policies of any third parties with which you interact. We suggest that you ask any questions you may have prior to disclosing personal information.

Necessary for the Performance of the Contract between supermelon and its Members

supermelon provides a voluntary service; you can choose whether or not you want to use the Services. However, if you want to use the Services, you need to agree to our Terms of Use, which set out the contract between supermelon and its members. As we operate in countries worldwide (including in the US) and use technical infrastructure in the US to deliver the Services to you, in accordance with the contract between us, we need to transfer your personal information to the US and to other jurisdictions as necessary to provide the Services. What this means, essentially, is that we must be able to move your personal information across international borders in order to perform our part in the contract between supermelon and you.

Keeping your personal information secure is of paramount importance to us. As a company, we follow industry-accepted standards to safeguard the personal information that we receive. This includes protection during the transmission of the information and during the full length of time that we store the information. As a supermelon user, there are a number of steps that you can take to help prevent unauthorized access to your account information, such as choosing a strong password and signing out of your account every time you finish your session on our platform. When certain sensitive information, like credit card numbers, is submitted to us, we encrypt it with secure socket layer technology (also known as SSL). While we follow industry-accepted standards for the protection of personal information provided to us, there is no digital means of transmitting or storing information that is entirely, absolutely safe. Because of the technological limitations on information safety, we are, unfortunately, not able to offer a 100% guarantee for the security of your personal data. However, we do offer numerous security settings and safeguards for our members. We encourage you to view the full details of our security practices in your account preferences, but a brief overview of these security features includes full-site SSL, two-factor authentication, and sign-in notifications.

9. Data Retention: How Long supermelon Will Keep Records of Your Information

If you decide that you do not want us to utilize your information in providing you with the Services, you have the option of closing your account. Otherwise, we will only store your personal information for as long as necessary, as defined by the purposes expressed in this policy, or for as long as your account remains active and we continue providing you with the Services.

supermelon will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy. In addition, supermelon sellers may also be required to retain and use your information in order to comply with their own legal obligations. It’s important for you to be aware that the termination of your account will not necessarily allow you to use your username, email address, or shop name on a new supermelon account. Please also note that we store log files for the purposes of internal data analysis. Except for a few specific cases (such as where they are necessary for the improvement of our platform or the security of the Site, or when we have a legal obligation to store them for a longer timeframe), we will typically only store these log files for a brief time.

10. Rights of supermelon Users

You may benefit from a number of rights in relation to your information that we process. Some rights apply only in certain limited cases, depending on your location. As a supermelon user, you have the freedom to modify, restrict, or remove much of the personal information associated with your account. You may do this either by contacting us directly or through your account preferences. You may also contact us to request information about what personal information of yours we have on file. In certain cases where we process your information, you may also have a right to restrict or limit the ways in which we use your personal information. In certain circumstances, you also have the right to request the deletion of your personal information, and to obtain a copy of your personal information in an easily accessible format. If we process your information based on our legitimate interests as explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Where we use your personal data for direct marketing purposes, you can always object using the unsubscribe link in such communications or changing your account settings. Please note that some changes to your account settings may take a few days to take effect.

11. Responsibilities of supermelon Users

You are responsible for protecting user personal information you receive or process and complying with all relevant legal requirements when you use the Services. This includes applicable data protection and privacy laws that govern the ways in which you can use a user’s information. Such laws may require that you post, and comply with, your own privacy policy, which must be accessible to supermelon users you interact with and compatible with this policy and supermelon Terms of Use.

As a data controller, to the extent that you process user personal information outside of the Services, you may be required under applicable data protection and privacy laws to honor requests received from such users for data access, portability, correction, deletion, and objections to processing. Also, if you disclose personal information without the buyer’s proper consent, you are responsible for that unauthorized disclosure. This includes, for example, disclosures you make or unintentional data breaches. For example, you may receive a buyer’s email address or other information as a result of entering into a transaction with that buyer. This information may only be used for supermelon -related communications or for supermelon -facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer’s consent, and subject to other applicable supermelon policies and laws, you may not add any supermelon member to your email or physical mailing list, use that buyer’s identity for marketing, or obtain or retain any payment information. Please bear in mind that you're responsible for knowing the standard of consent required in any given instance.

If supermelon and you are found to be joint data controllers of personal information, and if supermelon is sued, fined, or otherwise incurs expenses because of something that you did in your capacity as a joint data controller of buyer personal information, you agree to indemnify supermelon for the expenses it occurs in connection with your processing of buyer personal information.

12. How to Withdraw Consent Granted to supermelon

At any time, you have the option of revoking your consent to our utilization and processing of your personal information. To end our use of your information and your use of the Services, you can close and delete your supermelon account. You can do this by navigating to the “Privacy” tab within your account preferences. Assuming that there are no outstanding bills, unresolved disputes, policy violations, unfulfilled orders, or other pending issues with your account, we will send an email to confirm the termination of your account. Once you confirm your request, the process will take up to two weeks, at which time (to the extent allowed) your account will be closed and deleted.

Depending on which of our Services you've used (such as whether you've made purchases or sales on Supermelon.), we may be required to retain certain information for legal, regulatory, tax, security, or compliance reasons for a limited period of time, after which it will be deleted. This deletion is permanent, and your account cannot be reinstated.

13. Changes to Our Privacy Policy

It’s important to note that this privacy policy may be occasionally amended or updated. If we feel that any modifications being made are germane to your use of the Services, we’ll inform you about them in one or more of the following ways: (1) publishing the changes via the Services, (2) sending an email or message to communicate the changes, or (3) publishing a new update to the Apps’ platform in the version notes. It will be up to you to decide whether you wish to continue using our Services according to the new Terms. It is your responsibility to review any changes.
